Fraudulent actions of a brokerage company Trade12

At the moment the balance on the account number 1065488972 in the company Trade 12 is positive and amounts: 29,921.34 USD (twenty nine thousand nine hundred twenty-one dollar thirty-four cents). This fact is confirmed by the letter addressed to Trade12. On the 14.11.2017 my account is blocked, from that date I can not withdraw my money. Since 15.11.2017 I wrote daily regarding this to Trade12. During this time my Deposit is reduced every day. Withdrawals can’t be made for the following reason (terminal in the withdrawal section produces the following) :

30.11.2017 I finally get a response from them that I can't withdraw funds from my account because I have two opened orders for oil contracts for the identification number cl-dec17, which was Expired 17.11.2017. These warrants are still for some reason in my terminal. Yesterday my broker Vladimir Zhdanov has informed me that these are CFD contracts, not contracts that are traded on the world exchange. But in any case, even if it is CFD contract it should be closed automatically or prolonged to the next period. This condition is specified in the regulations of Trade12, in accordance with the Terms and Conditions Trade 12 Policy, Section 10. Customer responsibilities: when a contract/asset expires, failure to close any open trades related to it will result to an automatic exit. Thus, open trades will be closed accordingly. An account can be exempted from automatic exit is provided it is presumed to be in a good standing and stature. In such case, the option to transfer to another liquidity provider.

In addition, Vladimir Zhdanov, a Manager of the company Trade 12, during this time required money from me for the expiration. He said the amount what I need to deposit, is 11 000 USD. I said it is contrary to the rules, and is unreasonable and unlawful. Then, on the 30.11.2017 they offered me to sign the contract, according to which they will extend the contract cl-dec17, saying that my account will decrease by 8 400 USD. The contract I received on mail, but it was just unreadable, it was simply impossible to read it.

On 28 November I realized that Trade 12 is cheating on me, and does everything in order so I could not get the funds from my account.

In connection with these violations on the part of Trade 12 (regulations, paragraph 10), ignoring my requests, ban of withdrawal of my funds, unwarranted account blocking, I have terminated my contract with Trade12 by notifying them about the termination of the contract and asked to return the funds from my account. Company Trade 12 ignores all of the arguments and just brazenly does not return the money.

The Commission on regulation of relations in financial markets ( KROUFR) have placed my claim to Trade 12 on its website, available here (https://kroufr.ru/forum/index.php?topic=25496.new#new).

Due to the fact that I'm preparing for court I collect evidence about illegal activities of Trade 12.

In it’s letter Trade 12 indicates that the company Trade12 is registered at the Marshall Islands, is owned and operated by Exo Capital Markets Ltd, and operates under the laws of the Republic of the Marshall Islands under registration number 68798.

On its website https://ru.trade12.com company Trade 12 States that it is a regulated brokerage company. This statement is false and misleading.

Due to the fact that I'm preparing for trial I sent a request to the INTERNATIONAL REGISTRIES, INС ., which is providing support to the Marshall Islands Maritime& Corporate Administrators. They informed me that:

Exo Capital Markets Ltd nor Trade12 don’t have licenses for brokerage activity, and accordingly are not regulated by any regulatory authorities, they are a foreign company and are registered as: "Consulting center". Therefore, the service of the financial markets as a Forex broker offered by the Company Trade12, cannot be provided to consumers.

I sent a query to Trade12:

Regarding your letter in which you say I can’t withdraw because I have 2 open trades on CL-nov17. I want to inform you, I couldn’t close these trades even before expiration. The MT4 platform was given me an error when I tried to close these trades. I wrote many times to my broker and on company’s mail, but I was just ignored. My broker said me I need to invest more 9000-11000$ in order to extend the contract on these trades. I have saved this correspondence.

Now, regarding the absence of the licenses of the company Trade 12. In a previous letter you confirm that you are registered at the Marshall Islands. I sent a request to the registration authority of the Marshall Islands. They respond that you don’t have a license to provide brokerage services. That means the information you state in your site, that ” company Trade12 is a legally regulated brokerage firm that has all the necessary licenses and documents” — is false!

Based on the foregoing, I ask:

1. Submit scanned license of Forex brokerage activities.

2. Answer why in my terminal there are still two oil contract, despite the fact that the expiration on contracts cl-dec17 was held 17.11.2017 and Trade12 was obliged to turn my position into cash.

3. How the company Trade12 offers me to close orders for expired contracts.

4. When Trade 12 will produce the closure of these two orders, because in terminal I can not close.

It usually involves a person or entity contacting a member of the public out of the blue and offering the opportunity to buy shares or other financial products that may or may not exist. We have found that many of these contacts originate from overseas.

ASIC and overseas investment scams

As part of our ongoing awareness campaign ASIC maintains an online blacklist of unlicensed overseas entities on its consumer website, MoneySmart, to warn the public about investment scams.

Trade 12 is known to ASIC and already listed on MoneySmart's list of 'companies you should not deal with'.

What you should do

If you have already responded to an investment scam and transferred money to a scammer’s bank account, it is very unlikely that it will be able to be recovered. You should contact your Bank immediately as they may be able to stop a money transfer or close your account if the scammer has your account details.

Look out for follow up scams

Please be aware, you may be the target of a follow-up scam. Most commonly, follow up scammers will try and get you to pay an upfront fee. Do not transfer any funds to someone asking for an upfront fee. The following are some tricks to look out for in case you are a target of a follow up scam:
° An offer to swap your investment for another one to recover your losses
° An offer to buy your shares at a premium but asking you to pay a fee to have 'restrictions' on the shares lifted
° Asking you to pay a fee for a fake share certificate
° Claims they can recover your losses for a fee they say is a tax, deposit or refundable insurance bond
° Asking you to pay for travel and accommodation costs to find the scammer who has taken your money

If you are contacted by a new entity that appears to be a follow-up scam, the best thing to do is to hang up, delete the email or otherwise ignore the contacts.
