UPDATE:
I have received 75% of my cash back from Westpac.
I received a win against ANZ, the second Australian bank involved in this scam act of white collar stealing.
FOS ruled that because I had to ring them to get my card unblocked, yet ANZ did not mention ASIC had notified ANZ that BDB was a known scam and I should not deal with BDB, ANZ are held liable for my loss. 100% in my favour. Not the standard 75%. Go for it people!!!!
 
I am so happy for you Aussie Scammed-if ever we needed convincing " you get back what you put in" this is it- Congratulations !!!! - Till you mentioned FOS I had not even heard them mentioned.
I have also spread your msg to other members in other groups, not just in Aussie by the way- but UK and beyond. I am really glad I asked you to expand your thread, too.
I really seem to have p'''ssed off NAB thanks to your excellent article. In the 3 way link- up between Nab's lawyer, FOS and me -their words:
"IT SEEMS YOU HAVE BECOME A BIT OF A CHAMPION FOR THE VICTIMS" - I knocked back their $3,500 first offer, then their $4,500 second and final offer even though they said it far exceeds the normal deal.
You have given me a lot more assurance- but each bank will probably muddle their way thru. I hit them right on the head with my big stick- Nab's lawyer had no idea that I had presented FOS with evidence that Nab had been notified by ASIC way before my scam, and I also sent them a copy v the txt their fraud squad sent me: no mention v a scam- During the conference I told them I believe I am entitled to the whole sum of $50,000 usd. back Their lawyer admitted he was appalled by the scam.
He said-even though it may not please some customers, now they will not release any deposit money to any known scammers on the ASIC list. Strange that, isn't it?-they were the exact words I said in my first submission to Nab. I also hit them with the fact that we know that 1% to 2% v the deposit transfer fee goes towards the banks and Visa . I said 2% of approx. two billion dollars world wide is a lot of money and it doesn't look good when people know the banks are benefitting from a scam. Man -the lawyer quickly denied that, but I'm hoping I had done enough damage to Nab by then!!!!

If FOS really are mediators, then I reckon Nab are in trouble, they stuffed up their defence. Whereas they thought they had it in the bag-they said they only received notification in Jan 2017, and the fraud squad had warned me OFM was a scam-in reality they had nothing.

Im so happy for you Aussie Scammed. You give us a sign of hope.. I wonder if I have the same FOS case manager as you? That would be an advantage. How long did the FOS take to make the decision?

Im dealing with Westpac as well. So its been confirmed westpac had been informed about the scam through ASIC?
Is this the only point you argued on or had others? I assume this the most important point of the argument?
You mentioned BDB ...i wonder if it applies to option.fm as well or I will need to tell the bank BDB owns Option.fm....
 
Tolly, NAB sounds like the most difficult player amongst all the bank however they seem to tell you alot. Westpac refuse to tell me anything. They did not even respond to FOS within 28 days and changed the person who started to look at my case

Hi guys-don't forget that like most v us I started with no hope. When I read some threads on FPA I quickly realized its power. Sorting the wheat from the chaff was immensely empowering and I followed Pharaohs instructions to a tee, even tho I didn't understand the terminology back then. I attacked the bank with knowledge gained here from day one. It was current and informative-right up to date and they realized their archaic systems were being challenged in a systematic manner, from all corners off the world for the first time. I stumbled around until I found voice with a victory against BinaryBook. By then I knew how Nab worked and they knew I knew how they worked. By systematically attacking them with new information they had no choice but to lead me into going to FOS. They sort of wanted to dismiss me to FOS to get me of their case.
Ha, It didn't work, did it? By then I had discovered Aussie Scammed, and hopefully, as they say, the rest is history. For me FPA is about doing the work, being disciplined and helping others-the PeaceArmy bit. Even if I don't get a dollar back from the scammers, I have grown as a person and man I carry a mean stick! I attack them with snippets cut and pasted from media gleaned from all sections of the media, they don't like it! -tuff love, indeed.
