are you claiming the Terms and Conditions posted by Ogbeide are not from your company?
FXTM just replied me that they are agent to Exinity limited and Fxtm w/a limited is not a broker.
Is this true

Please be informed that FXTM is a brand name of Exinity Limited company, while FXTM Trading W/A is a Collecting Agent which provides services to Exinity Limited. FXTM Trading W/A is neither a broker nor a member of the Exinity Limited company, therefore it is not in any way involved in the execution of the Client’s (Ogbeide’s) transactions.
At the same time, please note that Exinity Limited is a broker licensed and regulated in various jurisdictions, operating under the brand of FXTM. The Client agreement is concluded between the Client (Ogbeide) and Exinity Limited.
On the basis of the above, the Client (Ogbeide) shall send any complaints to Exinity Limited, not FXTM Trading W/A.
In addition to the aforesaid, if, after the dispute has been addressed on Exinity Limited’s side, but the Client is not satisfied and believes the issue still persists, to resolve the dispute he/she should file a complaint through the Financial Commission, which is an independent external dispute resolution organization.

Thanks for your detailed reply and there are no accusations in my post but instead a question. Based upon your response, the client agreement is concluded between the Client (Ogbeide) and Exinity Limited. The agreement provided to Ogbeide are the Terms and Conditions from FXTM therefore the execution is based upon your published terms regardless of who provided them to Ogbeide. Ogbeide signed up for an account, was provided your Terms and Conditions and accepted the account and trading conditions based upon those Terms.

Does FXTM acknowledge and understand Exinity is using FXTM's terms and conditions to present to their clients? If Yes, then FXTM was already aware these are the terms used by the clients of Exinity and therefore fully understood those terms should be adhered to by any client and that broker for accounts with Exinity. If No, then it is likely in FXTM's best interest to intervene and understand why the terms were being used by Exinity without FXTM's knowledge or consent. Lack of knowledge or consent does not absolve liability under those terms especially since FXTM has an existing relationship with Exinity. We look forward to your reply.

These are not two separate entities. Exinity Limited has the full right to provide services under this trademark. FXTM Trading W/A is a separate legal entity that does not represent a trademark, but is only an agent for receiving funds for a specific region in favor of a broker, and as stated earlier, it is not a subsidiary of Exinity Limited.

Thanks for the additional details. Since Exinity has the right to provide services under the FXTM Trading trademark and the fact that FXTM's Terms and Conditions are used by Exinity then there is a proprietary relationship between these two companies, the services offered and the terms extended to clients. I am not able to find any terms that state Exinity shall indemnify and hold FXTM harmless when FXTM's terms are used by Exinity to conduct business with their clients. If this language exists then please post in this thread. If this language do not exist, we kindly ask for your assistance to get this resolved. .

We suppose you still do not fully understand the difference: there is no such a company or trademark as FXTM Trading. There are two separate entities: FXTM (which is a brand name of Exinity Limited) and FXTM Trading W/A (which is not a broker nor is part of the trademark). Please note, that we have provided a full detailed information on the Client's (Ogbeide's) situation in a letter to him. If the Client still has questions, he can address them to our Company in a letter, or file a complaint through the Financial Commission for resolution.
