Financial Markets Authority (FMA):

Dear Rodrigo,

Thank you for contacting the Financial Markets Authority (FMA) with regards to Global Derivative Capital Markets NZ Limited.

We understand that you are having difficulty in accessing funds held on your account with this company.

The company is not, and has never been, authorised or licensed by the FMA. This entity is also no longer part of a Disputes Resolution Scheme you will need to seek independent legal advice about what other action is available to you.

The Financial Service Providers (Registration and Disputes Resolution) Act 2008 requires a company that is carrying out the business of providing financial services in New Zealand to be registered and the company name to be listed on the FSPR, which can be found at www.fspr.govt.nz.

The government agency responsible for the registration of Financial Service Providers (FSPs) is the Registrar of Financial Service Providers and the registration process involves making an on-line application to them. As part of the process limited criminal checks are also done on the principals of an entity.

The FSPR was set up to allow the public to check if FSPs are registered; obtain their business address; find out about the types of financial services FSPs are registered to provide and if they belong to a dispute resolution scheme.

It is important to be aware however, that being registered does not involve any licensing or determination by an authority that a FSP is a fit and proper person.

More information on the prerequisites for registration can be found here: http://www.business.govt.nz/fsp/abo.../what-are-the-prerequisites-for-registration/

FMA does not provide security or confirmations of legitimacy for any entity and currently does not actively monitor this entity. For information about FMA and what we do, we refer you to our ‘What we Do’ page of our website http://fma.govt.nz/fmas-role/what-we-do/.

Kind regards
Kirsty McKenzie

New Zeland Police:

Hi Rodrigo, thanks for contacting us.
From what I read, it appears that withdrawals are an approximate time, according to their website.
Additionally unless there has been a criminal offence, ie theft or fraud, we are unlikely to investigate from a police perspective.
Perhaps get in touch with us if they don't provide your funds within another week.

Hi Rodrigo, if you are wanting to report this as fraud you need to report it to your local police initially. Thanks, TL.

Hi Rodrigo, you need to make your report to your local police, in Brazil, and if appropriate they will liaise with New Zealand Police via Interpol.
You can always consult a lawyer here in New Zealand.
