la descrizione del mio problema nel ritiro della liquidità è gia ampiamente illustrata all inizio di questa discussione. (tutti i membri della FPA possono leggere e capire velocemente il problema ).

Se desidera la traduzione in lingua inglese con tutti i dettagli ( le mail scambiate sono tante che risulta difficile postarle tutte ) le posso mandare una mail con tutti gli allegati ( tramite Bill ).

I suggest that we keep the entire discussion public in these forums. I also don't understand why you continue to insist NOT to publish the ENTIRE story of what happened to you from the beginning to the end. You are leaving out quite a bit of details...

Requesting that you provide your entire complaint from the beginning until the end in English is a legitimate request please do so so that we can move forward with this case.

nel Dicembre 2011 sono stato contattato da un manager della YoutradeFx e più precisamente dal sig. Daniele Rosati, dopo una serie di mail e telefonate ci accordiamo per l' apertura di un conto reale Forex con la sua società ( YoutradeFx per l' appunto ), con un versamento iniziale di 240.000 EUR.
Dopo un certo periodo decido di aumentare la liquidità sul conto di altri 30.000 EUR ( fine Aprile 2012 ).
I primi di Luglio 2012, visto che le condizioni applicate al mio conto non mi soddisfano più ( tassi swap troppo alti ) decido di ritirare la liquidità presente sul conto.*
Chiedo informazioni al mio manager, che attualmente era diventato il sig. Mark Santo ( il manager Rosati non lavorava più per loro ), per estinguere il conto, ma dopo circa un mese di scambio di mail mi vengono proposte delle nuove condizioni ( mail in inglese ), ovvero tassi swap free*su tutte le valute senza costi nascosti ( gli ho proprio fatto la domanda diretta ), io in cambio avrei dovuto versare 50.000 $ o 40.000 €.
A questo punto riprendo a negoziare le valute con le nuove condizioni (soprattutto USD/HKD con 450 lotti ) e tutto procede come mi era stato promesso ( nessuno swap applicato ).
Da Marzo 2013 il mio account manager era cambiato nuovamente nella persona del sig. Richard Maretti con il quale mi sentivo telefonicamente per alcune operazioni eseguite insieme.
In Maggio 2013 decido di far rientrare tutta la mia liquidità presente sul conto ( esattamente 237.104,86€ + 2900€ dovuti al rimborso di 5 pips sulle posizioni chiuse da poco sul cross USD/HKD come da accordi ) con la relativa richiesta di prelievo eseguita sul loro sito accedendovi con le mie credenziali.
Da questo momento sono sorti i problemi ed è intervenuto anche un altro manager ( sig. Angelo Benedetti ).
Dopo inutili tentativi di convincermi ad annullare la richiesta di prelievo totale tramite mail e telefonate, entrambi i manager ( Maretti e Benedetti ) mi confermano che il bonifico da li a breve sarebbe arrivato sul mio conto in italia ( richiesta eseguita il 15 Maggio 2013 ).
Il giorno 23 Maggio mi arriva una mail della YoutradeFx che mi dice che la mia richiesta è stata negata e di contattare il proprio manager per chiarimenti (nello stesso giorno il conto mi è stato bloccato e io con le mie credenziali non riesco più ad accedervi ).
Chiamo il sig. Maretti che mi conferma che il lunedì successivo avrei avuto la contabile del bonifico ( da me richiesta ) e in pochi giorni i soldi sul conto.( mi sembrava strano visto la mail che mi era arrivata ).
Il lunedì mattina ( 27 Maggio 2013 ) mi arriva una mail di un certo sig. Paul Watson che si presenta come il capo del servizio clienti della YoutradeFx e mi scrive che la mia liquidità sarà decurtata di circa 166.000 EUR per i tassi swap da applicare alle mie operazioni eseguite da Agosto 2012 ad oggi.
Rispondo all a mail allemande le condizioni che mi sono state concesse da quel periodo in avanti e dopo 10 giorni mi ricontatta dicendo che il manager non aveva l autorizzazione per concedermi queste condizioni e che lo avrebbe fatto esclusivamente per danneggiare la società..pero' infine scrive che sono disposti ad un compromesso ( sanno di non avere ragione ).
Dopo varie mail da parte mia dove li sollecito a procedere con il bonifico (237.104,86€ + 2900€, ovvero circa 240.000€ ) o mi riterrò costretto a procedere per vie legali, diffondendo la notizia anche sui vari forum e segnalazioni a Consob e FCA, mi ricontatta il manager Angelo Benedetti (13 Giugno 2013 ) per trovare un accordo dicendo che la società non può rimetterci dei soldi per una infrazione commessa da un suo Manager (praticamente vogliono che ci rimetta io per un loro problema interno ).

Morale della favola: ad oggi non ho ancora ricevuto i miei soldi.

A questo punto come devo procedere?

Adesso che ho dato prova d identità, può rispondere ad alcune domande?

-La societa con cui ho aperto il conto forex è la youtrade Holding limited BVI ?
Questa societa non risulta regolamentata, nonostante quando ho aperto il conto mi era stato garantito il contrario.

-Potrebbe inviarmi il contratto che ho firmato con la vostra società?

-Visto il tempo trascorso, vorrei sapere quanto tempo ancora devo aspettare per riavere i miei soldi?

I can clearly see that Mr. Santo has stated

Our agreement:
1. Swap free account (you won't pay or receive swaps at all)
2. refund of 5 pips on USD\HKD pair at the end of each month to your balance.
3. Your bonus was re-instated in your account after your withdrawal was canceled, money was moved from credit to your balance (still need to work on getting the rest of it 2261EUR to your balance - per your last email)
4. You increase your investment by 50K (or more if you so choose).
5. I, Mark Santo, would be your account manager (Head of strategy services department) and will help you with anything you may need.

As a Head of Strategy Dep, he must have had all rights to amend the current conditions. Once changed, the conditions must remain the same until BOTH parties agree on a change! Did YTF contacted Mr. Robino and asked for his point of view?! I bet they didn't and have changed the conditions solely.
Let me point that Mr. Santo has been working for YTF ( evidence provided ) and as their employee he must be responsible for all his acts! Therefore, it is completely unfair to contact your clients and ask for compensations, new amendments, new conditions etc. because the person is no longer working for YTF! If YTF has faced huge losses, it is not the client who must compensate the company but the employee who has allowed such losses to occur!
From my point of view, YTF are not only guilty, but they are acting against all their clients!

il giorno che ho deciso di ritirare i miei soldi hanno cercato in tutti i modi di farmi annullare la richiesta inventando mille scuse.
Fino al giorno prima del ritiro anche il Manager Benedetti mi confermava che sul conto erano presenti 240k EUR e mi ha inviato una mail dove indicava le condizioni contrattuali ( le stesse concordate con M.Santo ).
Dopo hanno iniziato a negarsi al telefono e mi hanno fatto contattare da un altro manager (Paul Watson), il quale mi ha scritto 2 volte poi è sparito.
Per quanto riguarda il manager M.Santo confermo che ha lavorato per la ytfx.

ho già contattato un avvocato a cui ho inoltrato tutta la documentazione necessaria ( bonifici, mail scambiate con tutti i manager e relativi accordi sottoscritti ).

Gli ho invitati piu volte ad effettuare il bonifico, anche tramite un reclamo ufficiale alla società ( raccomandata internazionale ).

Ad oggi ancora niente soldi.
