Ponzi Scheme Managed Account Question - Courtenay House Trading Group

Hi All

I just want to say I have great sympathy for all the people involved. It is so sad to see something like this.
I am not writing to defend Courtenay or against them. ASIC is the appropriate body to determine that.
I just want to speak of the facts here.

1. In FX, Futures and Commodity Markets, good managers usually with big investment banks can achieve incredible results. 7.5 % per month is acutally realistic in the right hands and also is subpar results to really good managers.
2. I was contracted to do trading for them as a contractor not employee capacity hence no idea how their company works. However I have done my DD and at the time which is 1 1/2 months ago that they held a license with AMH (Australian Mutual Holdings) which was revoked as everyone knows on 27th April 2017.
3. Courtenay do perform real trading with the funds that was in a FX broker account. Here are the actual trades made by me as a contractor. Started 27th March to 19th April which showed on a 500k Real Account, 242k profit was produced which is almost 50% return for the month.
The account was disabled upon ASIC court orders on 21st April.

I feel terrible for all involved. I hope this information give all people involved some comfort that Courtney does try to make a return on your money. To what extent and where all the funds go I dont know. I was only a contractor and POA on a 500k account.

As to the fine print why it is under ASIC investigation, time will tell. I sincerely hope ASIC will resolve this issue and return all your money back or partial if possible.

I've just received word from the investment group I am part of, they work very closely with Courtenay House. I will post the email below, I honestly think that ASIC are making things out to be much worse than they are, they are bullies in the finance industry.

Hello everyone,

We have taken information from different documents and people over the past 24 hours to try to get some understanding on the ASIC case.

We can say that the Insurance is real, we have again verified this with the insurance broker who Courtney House has the insurance with. The insurance covers professional Indemnity, Crime and Cyber liability. YOU CAN NOT CLAIM ON THIS UNTIL ONE OF THOSE THREE ISSUES HAVE BEEN PROVEN TO BE INSTIGATED.

The other pressing point is whether your capital is safe. We have assumed that everyones capital is still in the bank accounts and in trading accounts of Courtney House. The figure stated in ASICs media release refers to only one bank account. There are more funds in trading accounts. The insurance relies on systems that make it very difficult for any two people to remove money from trading accounts and trust accounts and put them into other accounts. I believe there are many touch points that stop this from happening. The insurance covers only a part of the funds because the removal of money from the funds completely is not possible. This is our understanding and can not be taken as advice.

We have spoken to the head of the accounts department at Courtney House and he will be issuing an email within the next few days with a formal response from their solicitors. Courtney House have been told they are not to release any more information to clients as this needs to be done through their solicitors as the matter is with the High Court. As you can understand any lack of communication from any representative of Courtney house is likely to be because of advice from their barristers rather than malicious behaviour.

I will reiterate, there has been no misconduct found at this stage and ASIC are simply conducting enquiries. They have indicated that to us. This is the why they do it. I know it seems harsh, though looking at the bigger picture, they are doing their job looking after the wider community. Letting them know that you had been advised on the risks, that you are a sophisticated investor and your experience and that you believe the freezing of your funds should be dealt with in a quicker manner.

Hi All

I just want to say I have great sympathy for all the people involved. It is so sad to see something like this.
I am not writing to defend Courtenay or against them. ASIC is the appropriate body to determine that.
I just want to speak of the facts here.

1. In FX, Futures and Commodity Markets, good managers usually with big investment banks can achieve incredible results. 7.5 % per month is acutally realistic in the right hands and also is subpar results to really good managers.
2. I was contracted to do trading for them as a contractor not employee capacity hence no idea how their company works. However I have done my DD and at the time which is 1 1/2 months ago that they held a license with AMH (Australian Mutual Holdings) which was revoked as everyone knows on 27th April 2017.
3. Courtenay do perform real trading with the funds that was in a FX broker account. Here are the actual trades made by me as a contractor. Started 27th March to 19th April which showed on a 500k Real Account, 242k profit was produced which is almost 50% return for the month.
The account was disabled upon ASIC court orders on 21st April.

I feel terrible for all involved. I hope this information give all people involved some comfort that Courtney does try to make a return on your money. To what extent and where all the funds go I dont know. I was only a contractor and POA on a 500k account.

As to the fine print why it is under ASIC investigation, time will tell. I sincerely hope ASIC will resolve this issue and return all your money back or partial if possible.

I've just received word from the investment group I am part of, they work very closely with Courtenay House. I will post the email below, I honestly think that ASIC are making things out to be much worse than they are, they are bullies in the finance industry.

Hello everyone,

We have taken information from different documents and people over the past 24 hours to try to get some understanding on the ASIC case.

We can say that the Insurance is real, we have again verified this with the insurance broker who Courtney House has the insurance with. The insurance covers professional Indemnity, Crime and Cyber liability. YOU CAN NOT CLAIM ON THIS UNTIL ONE OF THOSE THREE ISSUES HAVE BEEN PROVEN TO BE INSTIGATED.

The other pressing point is whether your capital is safe. We have assumed that everyones capital is still in the bank accounts and in trading accounts of Courtney House. The figure stated in ASICs media release refers to only one bank account. There are more funds in trading accounts. The insurance relies on systems that make it very difficult for any two people to remove money from trading accounts and trust accounts and put them into other accounts. I believe there are many touch points that stop this from happening. The insurance covers only a part of the funds because the removal of money from the funds completely is not possible. This is our understanding and can not be taken as advice.

We have spoken to the head of the accounts department at Courtney House and he will be issuing an email within the next few days with a formal response from their solicitors. Courtney House have been told they are not to release any more information to clients as this needs to be done through their solicitors as the matter is with the High Court. As you can understand any lack of communication from any representative of Courtney house is likely to be because of advice from their barristers rather than malicious behaviour.

I will reiterate, there has been no misconduct found at this stage and ASIC are simply conducting enquiries. They have indicated that to us. This is the why they do it. I know it seems harsh, though looking at the bigger picture, they are doing their job looking after the wider community. I'm a big investor with courtenay house and I have never had any issues whatsoever with the way trading and banking has been done in the past. We also have never received any financial advice from them as is stated by asics. We have always known the risks involved when doing force trading.
We believe what you are saying but wish asic would share more information regarding their investigation.

As I am going through vigorous licensing requirements for the last 12 months, the following I have learnt from this pain staking process but has to be done by the book.

In Australia all financial services and companies are governed by ASIC. For certain financial products and service it will require a license from ASIC. ASIC is the most well organised and strictest amongst all regulatory bodies on this planet.

There are 2 different groups of clients ASIC recognises and and licensing are different for each group.

Retail Clients
ASIC is very strict on who can have retail license and the services or products provided. This is because most retail clients are financially naive and can be lured in by the returns they can get but without weighing up the risks. That is why ASIC is super strict. These are your mum and dad investors who rely on an investment to supplement their living costs and to part their money in a bad investment will bring very difficult financial hardship on their family. Therefore ASIC is extremely strict in compliance of any financial services or company that cater for retail clients. Your typical retail client invests less than 500k.

Wholesale Clients
ASIC will see this as lesser of the 2 risks for wholesale, as it is assumed wholesale clients are sophisticated investors who already know the risks of the financial services or products they are involved in. Wholesale Clients are 500k above investors and few requirements from the client accountant.

Regulations

All financial services and providers and companies require a license in Australia under ASIC.

There are a few diffrent ways a company can be licensed.

A company has an full AFSL license issued by ASIC. This company must have 3 responsible managers and full compliance team to meet ASIC requirements. Not all AFSL license holder can do all financial products. ASIC places strict conditions what the AFSL licensee can do.

CAR (Corporate Authrosied Representative), This is usually a representative under an AFSL licensee which needs vigorous requirements on the Authroised Reprensentative and the company eg in my case I have to do a RG 146 Course in Generic Knowledge FX and Derative in a wholesale capacity. Each component may take up to 3 months to complete. Retail RG 146 is even longer. What does this mean ?
It mean I can not give advice to retail clients as I only have wholesale RG 146. The licensee will need to a DD on the company and the AR to make sure they are legitimate and all claims must be backed up by real account trading proofs.


Clients Funds (investment schemes)

There are generally 2 schemes

MDA (Managed Discretionary Accounts)
The clients open their account with a FX/Future broker usually a broker your CAR or AFSL company suggests as it needs to comply with the CAR and AFSL requirements. The CAR or AFSL holder then has the authority to trade clients account. Fees are negotiated between the provider and the client.

This again falls into retail or wholesale clients.

Managed Investment Scheme (MIS)

This is where the clients place their money with the AFSL license holder company trust account.
The funds are pooled together and all investment decision is made by the licensee or the Investment Manger the AFSL licensee appoints.
The requirement for MIS AFSL needs to be minimum a public company. A private company can operate a MIS but as an Investment Manager capacity under a fully license MIS AFSL holder.


I sincerely hope you can make informed decisions in the future regarding investments and also all the regulation a finance company need to comply with.

It is taking me a long time to meet all the requirements to just operate as a CAR under an AFSL. I am in the final stages of Due Diligence.

I have quite some money invested with Courtenay House and heard about this forum from someone else invested as well. I have spoken to one of the people that work there and have assured me there is nothing to worry about. At this point in time it seems as though everyone's capital is being held and not going anywhere, until the investigation is over. Courtenay House already have the ball rolling with the new license and things should be resolved soon. Absolute worst case scenario is that everyone gets there money back. I don't think speculating things on this site makes anyone feel any better about the situation, and most of it isn't true to begin with. I've seen the past performance charts myself, they were even given out at a seminar I was at once, and a few others who have asked for them have received them.

I have a lot of faith in them, and I trust that nothing bad has actually happened. I've even spoken to the insurance people, and they have ensured that insurance is in place. However, no one can make any claims unless an actual crime has been committed, however, this isn't the case, as no crimes have been committed.
I just wanted to come on here to try and calm some people down. If anything, instead of speculating, I would call Courtenay House and speak to them about it like I did and find out what's going on from them.

I have always found Tony Iervasi to be pleasant and hardworking. We have met on a number of occasions at his office and discussed money. At no time since I first invested with Tony in 2013 have I had any concerns about my funds, their safety or the longevity of Tony's successful trading. I will admit that I had some concerns when David Sapina and Athan began playing a role, but my concerns were based solely on my intuition. I have a very significant amount of money invested (some $$$ millions) and I owe a fair amount of tax - first instalment 12 May - so I'm hoping that ASIC are able to release our funds in a timely manner. It should become clear very quickly that we, the clients, should not be punished while ASIC decide what they want to pursue. I would very much like to find out what process we would need to follow in order to withdraw our funds - if anyone knows, please pm me.

My thread/statement is not endorsing or criticizing Courtenay.
ASIC is taking action which is very serious. You need to get in touch with ASIC and enquire first hand.
I am not dampening your hope but you need to talk to ASIC what the issues are and how you are protected.
