Traders Court cases are not restricted to brokers. It doesn't matter if the money is in a brokerage account or placed in some sort of pooled investment.
Remember, Bernie Madoff had plenty of happy clients thinking they were safely earning 10% per year - until they found out that he'd been running a Ponzi scheme.
